Ratio Decidendi

The Court found that the Commission had established, on the basis of documentary and factual evidence, that the applicants participated in agreements and concerted practices restricting competition in the Italian flat-glass market, both in the automotive and non-automotive sectors, in breach of Article 85(1) EEC. The Court also upheld the finding of abuse of collective dominant position under Article 86 EEC, given the applicants' joint market power and conduct. The Court rejected the procedural objections, finding no breach of rights of defence or audi alteram partem. The fines imposed were found to be justified and proportionate to the seriousness and duration of the infringements.
