The Court held that the second subparagraph of Article 49(1) and point 20(B) of Annex IV of Regulation No 601/2012 are invalid insofar as they systematically include CO2 transferred to another installation for PCC production in the emissions of the soda ash installation, regardless of whether that CO2 is released into the atmosphere. This creates an irrefutable presumption contrary to the definition of 'emissions' in Directive 2003/87/EC and exceeds the Commission's implementing powers.
