Ratio Decidendi

Articles 2 and 46 of Directive 2004/18/EC preclude national legislation requiring, as a qualitative selection criterion, that tenderers provide proof at the time of submitting their tender of holding a registration certificate or approval issued by the competent authority of the Member State of contract performance, even where they already hold similar approval in their home Member State. Such a requirement is discriminatory, disproportionate, and contrary to the principle of mutual recognition. The principle of protection of legitimate expectations cannot be relied on by a contracting authority to justify such a breach of EU law.
