Ratio Decidendi

The Serbian judicial authorities failed to secure enforcement of the Commercial Court's final decision of 27 December 1990 for over three years and seven months after ratification of Protocol No. 1, with no evidence of complexity or debtor insolvency justifying the delay. This failure deprived the applicants of their possessions in violation of Article 1 of Protocol No. 1.

Orders
