  1. 1 Whether national legislation exempting cable retransmissions with up to 500 subscribers from authorisation requirements is compatible with Article 3(1) and Article 5 of Directive 2001/29/EC and Article 11bis(1)(ii) of the Berne Convention.

Ratio Decidendi

National legislation exempting simultaneous, full and unaltered cable retransmissions of national broadcaster's programmes from authorisation is not precluded if the public was taken into account by the rightholder in the original authorisation. However, legislation exempting communal antenna installations with up to 500 subscribers from authorisation is precluded, as its cumulative effect cannot be regarded as a case of minor importance under Article 5(3)(o) of Directive 2001/29/EC.

Partially allowed; national law not precluded for national broadcaster retransmissions if public was taken into account, but precluded for small communal antenna installations exemption.
