Ratio Decidendi

The Board of Appeal correctly found an average degree of visual and phonetic similarity between RUXXIMLA and RUXIMERA, and the goods are in part identical or similar. The double 'X' in RUXXIMLA does not create a sufficient difference to preclude confusion. The relevant public, even with a high level of attention, may still be confused due to imperfect recollection. Therefore, there is a likelihood of confusion under Article 8(1)(b) of Regulation 2017/1001.
