Article 16(1) of Directive 98/8/EC does not constitute a standstill obligation, but Member States must not adopt measures that seriously compromise the directive's objectives during the transitional period. Article 8(2) of Directive 91/414/EEC does not require compliance with Article 4 or Article 8(3) for authorisations of products already on the market two years after notification. Article 16(1) of Directive 98/8/EC has the same meaning as Article 8(2) of Directive 91/414/EEC. The definition of 'review' under Article 8(3) of Directive 91/414/EEC is for the national court to assess, and Article 8(3) only concerns the provision of data prior to review, not the organisation of the review...
