The State's failure for almost five years to enforce a final domestic judgment in favour of the applicant, without justification, violated both Article 6 § 1 of the Convention and Article 1 of Protocol No. 1, as the right to a court and peaceful enjoyment of possessions require effective enforcement of judicial decisions, and lack of funds is not a valid excuse.

Orders

  • The respondent State shall, within three months, secure enforcement of the domestic court award and pay the applicant RUR 3,132 in respect of pecuniary damage, plus any tax chargeable.
  • From expiry of three months until settlement, simple interest shall be payable at the marginal lending rate of the European Central Bank plus three percentage points.
