Ratio Decidendi

Directive 2004/35/EC, read with Articles 191 and 193 TFEU, does not preclude national legislation that imposes joint liability for environmental damage on landowners, in addition to operators, without requiring a causal link between the owner's conduct and the damage, provided such legislation complies with EU law and the principle of proportionality. Member States may also impose administrative fines on landowners under more stringent national provisions, so long as such fines are appropriate and proportionate to the objective of enhanced environmental protection.
