The Environmental Liability Directive does not apply to penalties for breaches of environmental law or to air pollution not affecting protected species, habitats, water, or land. The Waste Directive governs penalties for illegal waste incineration and requires that penalties be effective, proportionate, and dissuasive, in line with the polluter-pays principle. Penalties may be imposed on a landowner based on a statutory presumption of shared responsibility with the user, provided the presumption is rebuttable by reasonable evidence and the penalty is proportionate.
