Ratio Decidendi

Article 16(3) of Regulation No 404/93 does not empower the Commission to address individual hardship cases for importers allocated low quotas based on reference years. Article 30, however, authorizes and may require the Commission to adopt transitional measures for such hardship cases if they arise from the transition to the common market and are not due to the importer's lack of care. National courts are not authorized to grant interim relief pending Commission action under Article 30; only the Community judicature has jurisdiction in such cases.
