The cumulative effect of confidentiality restrictions on access to the case file, inability to use notes, and the privileged position of the Commissioner of the Public Interest placed the applicant at a clear disadvantage, violating the principle of equality of arms and resulting in an unfair trial under Article 6 § 1 and § 3 of the Convention.

Court Disposition

Violation of Article 6 § 1 in conjunction with Article 6 § 3 found; Government's preliminary objection dismissed; applicant awarded costs and expenses; other claims dismissed.

Orders

  • The respondent State is to pay the applicant EUR 1,220 in respect of costs and expenses within three months, plus any tax chargeable, to be converted into Polish zlotys at the rate applicable at the date of settlement.
  • From the expiry of three months until settlement, simple interest shall be payable at the marginal lending rate of the European Central Bank plus three percentage points.
