The Board of Appeal correctly found that the intervener had demonstrated genuine use of the earlier mark for the relevant goods, as the form of use did not alter its distinctive character. The marks at issue are visually and phonetically similar to an average degree, and the goods and services are identical or similar. Given the similarities and the relevant public's level of attention, there is a likelihood of confusion under Article 8(1)(b) of Regulation No 207/2009. The applicant's claims were therefore unfounded.
