National legislation requiring the beneficiary of rights under Directive 2010/64/EU and Directive 2012/13/EU to invoke procedural defects within a prescribed period is precluded where that period begins to run before the person concerned has been informed, in a language they understand, of the existence and scope of their rights to interpretation and translation and of the existence, content, and effects of the essential document in question. Such a rule undermines the effectiveness of EU law and the right to a fair trial.
