The production of polymers, including polycarbonate, in installations with a production capacity exceeding 100 tonnes per day falls within the scope of Directive 2003/87/EC, provided that the production itself gives rise to CO2 emissions, irrespective of any indirect emissions such as those from heat acquired from a third-party installation. Article 10a of Directive 2003/87/EC and Decision 2011/278/EU do not have direct effect, as the allocation of free allowances is subject to further implementing measures by Member States and the Commission.
