Ratio Decidendi

The Grand Chamber found that the domestic authorities had not sufficiently demonstrated that the most far-reaching measure—authorising adoption and severing family ties—was justified by an overriding requirement in the child's best interests. The authorities failed to adequately consider less intrusive alternatives and did not sufficiently facilitate family reunification. The procedural safeguards and reasoning provided were insufficient to meet the requirements of Article 8. Accordingly, there was a violation of the applicants' right to respect for family life.
