Ratio Decidendi

The applicants were denied the opportunity to appoint a lawyer of their own choosing at the pre-trial and trial stages, and the courts failed to provide adversarial proceedings or address their substantive arguments, impairing the overall fairness of the proceedings in violation of Article 6 § 1. The applicants' arrest, detention, and conviction for distributing leaflets paraphrasing constitutional principles constituted an unlawful interference with their freedom of expression, not prescribed by law, and amounted to a flagrant arbitrary act in violation of Article 10.

Court Disposition

Violation of Article 6 § 1 and Article 10 of the Convention found; just satisfaction awarded.

Orders

  • Respondent State to pay each applicant EUR 5,850 in respect of non-pecuniary damage, plus any tax chargeable, within three months, to be converted into the currency of Azerbaijan at the rate applicable at the date of settlement.
  • From expiry of three months until settlement, simple interest at the marginal lending rate of the European Central Bank plus three percentage points.
