Ratio Decidendi

Directive 96/34/EC is a legislative measure of general application, not a decision of individual concern. The applicant, UEAPME, does not possess a general or individual right to participate in negotiations under Article 4 of the Agreement, even if it was consulted at the initial stage. The exclusion from negotiations did not infringe any procedural or substantive right conferred by the Agreement or Community law. Therefore, UEAPME is not directly and individually concerned by the directive, and the action is inadmissible under Article 173, fourth paragraph, of the EC Treaty.
