Ratio Decidendi

The REA unlawfully suspended the TTD. EU grant agreement under Article 33.2.1(a) because the suspicions of fraud concerned a different grant agreement (NGA) and not the TTD. EU grant agreement itself. Article 33.2.1(a) only permits suspension for suspected fraud in the context of the same agreement. The REA's interpretation would render Article 33.2.1(b) redundant. The applicant failed to prove actual pecuniary or non-pecuniary damage resulting from the suspension, so the claim for damages is rejected.
