Ratio Decidendi

The Board of Appeal did not err in finding that the word elements 'atlântico' and 'atlántica' are distinctive for wines, that none of the elements in the marks is dominant, and that the marks are visually and conceptually similar to an average degree and phonetically similar to an above-average degree. Given the identity of the goods and the normal distinctiveness of the earlier mark, there is a likelihood of confusion under Article 8(1)(b) of Regulation 2017/1001. The applicant's arguments regarding descriptiveness and lack of distinctiveness were rejected as unsupported.
