Ratio Decidendi

It is not contrary to Articles 1 and 4 of Regulation No 3950/92 and Articles 3 and 4 of Regulation No 536/93 for a Member State, after checks, to correct individual reference quantities and recalculate additional levies after the final payment date, provided such measures comply with the principles of proportionality, legal certainty, and legitimate expectations. Notification of original allocation and any alteration of individual reference quantities to producers is mandatory, but the form of notification is left to national law as long as it ensures producers are adequately informed.
