Where a manufacturer in one Member State unlawfully equips vehicles with software that manipulates emissions data, and those vehicles are subsequently purchased in another Member State, the place where the damage occurs for the purposes of Article 7(2) of Regulation No 1215/2012 is the Member State where the vehicles were purchased, as the initial material damage (loss in value) is suffered there at the time of purchase.
