Ratio Decidendi

Where an unlawful act consists of manipulation of a product in one Member State, and the product is purchased in another Member State for a price higher than its actual value, the place where the damage occurred is where the victim purchased the product, provided that other circumstances confirm jurisdiction and the defendant could reasonably foresee being sued there. Article 7(2) does not allow the court to choose jurisdiction based on proximity or foreseeability beyond the criteria set by the Regulation.
