Ratio Decidendi

The Board of Appeal did not err in finding that the evidence submitted by Gianni Versace SpA established genuine use of the earlier mark for 'clothing' and 'footwear' in the EU during the relevant period. The Board also correctly found that the marks VERSACE and VERSACCINO are visually, phonetically, and conceptually similar, and that the goods are identical or highly similar. Given the average level of attention of the relevant public, there exists a likelihood of confusion within the meaning of Article 8(1)(b) of Regulation No 207/2009. The appeal is dismissed.
