Ratio Decidendi

The applicant failed to prove that the non-registered sign 'geographic' was used independently in the course of trade; the evidence showed it was always used in a subordinate position to 'napapijri' and not perceived by the relevant public as an independent indication of commercial origin. Therefore, the first condition of Article 8(4) of Regulation No 40/94 was not met, and the action for invalidity must fail.
