Article 6 § 1 ECHR applies to civil servants in salary/allowance disputes unless national law expressly excludes access to a court and the exclusion is objectively justified; in this case, applicants had access to a court, so Article 6 applied. The length of proceedings (over seven years) was excessive and unjustified, violating Article 6. The lack of an oral hearing did not violate Article 6 as the courts gave reasons and written procedure sufficed. There was no violation of Article 13 as effective remedies were available.
