  1. 1 Whether Article 2 of Directive 2000/78/EC prohibits an employer from treating differently individual members of a group defined by disability, based on an apparently neutral criterion (date of certificate submission), where that criterion is not objectively justified and the measures are not appropriate and necessary.

Ratio Decidendi

Article 2 of Directive 2000/78/EC must be interpreted as meaning that an employer's practice of granting an allowance only to workers with disabilities who submitted certificates after a certain date may constitute direct discrimination if the criterion is inextricably linked to disability and makes it impossible for a clearly identified group of disabled workers to satisfy the condition; such a practice may also constitute indirect discrimination if it puts certain disabled workers at a particular disadvantage without objective justification.
