Ratio Decidendi

The Commission erred in finding the applicants liable for a ceramics cartel in Italy for periods when they were the only ceramics manufacturer present at Euroitalia and Michelangelo meetings, as disclosure of sensitive information to non-competitors does not constitute a distortion of competition on the ceramics market. The fine calculation based on ceramics sales in Italy for those periods was incorrect.
