Ratio Decidendi

The provisions adding paragraph (4) to Article 67 of the Staff Regulations are intended to guarantee equality of treatment as between children by ensuring equivalent benefits, in terms of purchasing power, are paid to persons having custody. The applicant's situation is not exceptional and the rules must be applied uniformly. The principle of legitimate expectation does not entitle the applicant to maintain previous advantages. The reduction in drachmas paid is a consequence of the legislative aim to ensure equivalent benefits.
