Article 54 CISA and Article 21(1) TFEU, read in light of Article 50 of the Charter, preclude provisional arrest or further prosecution by a Member/Contracting State of a person subject to an Interpol red notice where it is established by final judicial decision that ne bis in idem applies to the acts in question. Member States must ensure legal remedies to establish this and must erase or prohibit further processing of such red notices. Where applicability of ne bis in idem is uncertain, provisional arrest may be justified but only to the extent necessary to verify applicability.
