The Court held that the Board of Appeal correctly found identity or high similarity between the goods in question and a medium degree of visual and phonetic similarity between the signs, with the verbal element 'SPAX' being dominant and the figurative elements negligible. There was no conceptual difference to neutralize the visual and phonetic similarities. Therefore, there was a likelihood of confusion for a significant part of the relevant public, justifying refusal of the mark under Article 8(1)(b) of Regulation No 207/2009.
