Ratio Decidendi

The Commission held that no relationship amounting to family life existed between the applicants within the meaning of Article 8, as the adopted child had always lived with his natural parents and the adoption was not recognized in English law. Article 8 does not oblige a state to grant entry for the purpose of establishing a new family relationship. Article 12 does not guarantee a right to adopt or integrate a non-natural child, and national law governs such matters. The application was manifestly ill-founded.
