Ratio Decidendi

Care leave allowance paid to an employee caring for a close relative in receipt of a care allowance in another Member State and on unpaid leave is a sickness benefit and cash benefit under Regulation No 883/2004. National legislation making grant of care leave allowance conditional on receipt of an Austrian care allowance constitutes indirect discrimination unless objectively justified by a legitimate aim and proportionate. National law making grant of care leave allowance and family hospice leave allowance subject to different conditions and precluding reclassification of applications does not violate Article 4 of Regulation No 883/2004.
