Ratio Decidendi

The Financial Regulation and Regulation No 966/2012 do not apply to Member State contracting authorities, even when contracts are financed by EU Structural and Investment Funds; national law applies. Under Article 32(2)(a) of Directive 2014/24/EU, as transposed into Bulgarian law, a contracting authority may, after an unsuccessful open procedure, approach a single economic operator in a negotiated procedure without prior publication, even if the contract does not have special characteristics justifying exclusivity, provided the contract conditions are not substantially altered.
