Article 28(2) of Regulation No 834/2007 must be interpreted restrictively; for products to be regarded as sold 'directly' to the final consumer or user, the sale must occur in the presence of both the operator or his sales personnel and the final consumer. Online and mail order sales do not meet this requirement and are not exempt from notification and control obligations.
