Ratio Decidendi

The Trustee is prohibited by clause 10.1 of the trust deed from providing any sum to Mr D, whether by way of commercial loan or otherwise, as the prohibition on 'Prohibited Benefits' includes loans to excluded persons. However, the trust deed did not reflect the true intention of the settlor, M, which was to permit such loans on terms conferring no benefit, and rectification is granted to add a proviso allowing loans to excluded persons on strictly commercial terms.
