Ratio Decidendi

The appeal is allowed on the limited basis that the Royal Court did not make a specific finding that the contacts used in the five emails were taken from any of the works specified in Schedule F. The matter is remitted to the Royal Court for determination of this issue. All other grounds of appeal, including those relating to breach of copyright and confidentiality, are rejected as the findings below were supported by evidence and correct legal principles.
