AG v Roberts (Royal Court : Sentencing (Criminal)) [2025] JRC 081 (24 March 2025)
The Court held that Jersey is not bound by English sentencing guidelines or the Millberry case for rape sentencing. Instead, Jersey courts must set their own sentencing policy, using English guidelines only as a cross-check for harm and culpability factors. The Court determined that sentences for rape of adults in Jersey have historically been too low and should be increased to reflect modern understanding of the harm caused and societal standards. The Court imposed a total sentence of 15 years' imprisonment, with detailed concurrent and consecutive terms for each count, and made orders under the Sexual Offences (Jersey) Law 2018 and Domestic Abuse (Jersey) Law 2022.
