The Court finds that the evidence does not support the assertion that the First Respondent's interest in CL and the Chateau Valeuse development was transferred as a sham or with intent to defeat the Petitioner's matrimonial claims. The transfer was motivated by financial constraints and the opportunity to pursue another development. No resulting or constructive trust is established in favour of the First Respondent, and the Fourth Respondent does not hold Apartment 14 or £950,000 on trust for him. The value of the First Respondent's interest in CL prior to transfer does not form part of the matrimonial pot for division.
