Procedural Posture

Application for Directions / Preliminary Hearing Prior to Trial

  1. 1 Whether the Court should enforce the undertaking in damages given in support of the Mareva injunction after discontinuance of proceedings
  2. 2 Whether the Court should order costs against the plaintiff after discontinuance
  3. 3 Whether a full trial on the underlying issue of forgery is necessary before deciding on costs and enforcement of the undertaking

Ratio Decidendi

The Court will proceed to a preliminary hearing to determine, on the assumption that the defendant did not forge the instructions, whether the circumstances of the institution, conduct, and discontinuance of the litigation justify not enforcing the undertaking in damages and not ordering costs against the plaintiff. Only if the Court cannot resolve the issue on this basis will a full trial on the underlying issue of forgery be ordered.

Court Disposition

Application for directions granted in part; preliminary hearing to proceed as outlined.

Orders

  • Two-day hearing on 10th December to determine whether, assuming no forgery, the undertaking in damages should be enforced and costs ordered against the plaintiff.
  • If the Court cannot decide without determining the truth of the forgery allegation, a further hearing with discovery and expert evidence will be ordered.
