Procedural Posture

Civil / Interlocutory Application for Leave to File Further Witness Statement

  1. 1 Whether the first third party should be permitted to file a second witness statement from its managing director out of time
  2. 2 Whether the managing director's second statement constitutes inadmissible expert evidence or permissible factual/opinion evidence
  3. 3 Whether costs sanctions should be imposed for late filing

Ratio Decidendi

The first third party's managing director, as a witness of fact, may provide evidence explaining the company's practices and opinions held at the time relevant to the dispute, but may not give independent expert opinion after the event. The second witness statement is permitted, subject to removal of inadmissible opinion/speculation, and the defendant is allowed to file supplemental expert evidence in response. The breach in late filing warrants an indemnity costs order against the first third party.
