Criminal / Pre Trial Evidentiary Ruling

  1. 1 Whether evidence of previous uncharged incidents involving the defendant receiving parcels containing drugs is admissible as bad character evidence under Article 82C of the Police Procedures and Criminal Evidence (Jersey) Law 2003
  2. 2 Whether the admission of such evidence would have an adverse effect on the fairness of the proceedings under Article 82E(2)

Ratio Decidendi

The evidence of the 2015 and 2018 parcels amounted to bad character evidence and could only be admitted if the court was satisfied that the defendant knew of the contents of those parcels. However, the admission of such evidence in this case would have such an adverse effect on the fairness of the proceedings that it ought not to be admitted, and therefore it was excluded under Article 82E(2).
