Ratio Decidendi

As the respondent had not paid the full purchase price, the property in the goods remained with the tenant. Consequently, the landlord was entitled to attach the goods in distress for rent arrears. The respondent was not entitled to a mandatory injunction for release of the goods, and the landlord's application for stay of execution was allowed with costs.
