The court found that the existence of an unsatisfied money decree and difficulty in tracing assets justified an order for oral examination of the Respondent's director under Order 22 Rule 35. The Environment and Land Court, being of equal status to the High Court and having inherent powers, can enforce its own decrees and, in appropriate circumstances, pierce the corporate veil to prevent abuse and ensure justice. However, the court stayed the prayer for personal liability pending the outcome of the oral examination.
