The Civil Procedure Act provides for the transfer of suits where a court lacks territorial jurisdiction, and the Small Claims Court, as a subordinate court, is subject to these provisions. The trial court should have directed the parties to apply for transfer of the suit to the appropriate court, rather than terminating the proceedings.
