In re VAR (Minor) (Adoption Cause E039 of 2026) [2026] KEHC 9317 (KLR) (Family) (25 June 2026) (Judgment) Neutral citation: [2026] KEHC 9317 (KLR) Republic of Kenya In the High Court at Nairobi (Milimani Law Courts) Family Adoption Cause E039 of 2026 HK Chemitei, J June 25, 2026 IN THE MATTER OF VAR (MINOR) AND EOM ................................ 1ST APPLICANT LAA ....................................... 2ND APPLICANT In the matter of EOM 1st Applicant LAA 2nd Applicant Judgment 1.In their Originating Summons dated 27th February 2026 the Applicants seek orders that:(a)The Applicants be authorised to adopt Baby VAR, the minor herein.(b)Upon adoption the child is to be known as VARO and the Registrar General be ordered to make appropriate entries in the Adopted Children’s Register in respect to the minor.(c)The Court be pleased to appoint PAO as the legal guardian of VARO upon granting the adoption orders.(d)Baby VARO be considered a Kenyan citizen. 2.The application is based on the sworn affidavits as well as the Applicant’s statements in support dated 27th February 2026. 3.The Court on 23rd April 2026 appointed AV as guardian ad litem and directed the Department of Children’s Services to prepare an appropriate report. 4.The said report dated 29th May 2026 which is on record is positive. The parties also appeared before the Court on 4th June 2026 though online and the Court interviewed them orally. 5.Based on the above and the paper trail on record this Court is satisfied about the entire process and it is of the considered opinion that the suit herein is meritorious. 6.The Originating Summons is therefore allowed as prayed and AV is hereby discharged as guardian ad litem. 7.Costs in the cause.
