**REPUBLIC OF KENYA** **IN THE HIGH COURT OF KENYA AT KISII** **SUCCESSION CAUSE NO. E017 OF 2023** **IN THE MATTER OF THE ESTATE OF THE LATE CHARLES MARAGIA GECHUKI (DECEASED)** **RULING** 1. This ruling is on the Summons for Confirmation of Grant. The same is dated 24th February 2025. It is supported by the Supporting Affidavit of JOYCE KWAMBOKA MARAGIA, sworn on even date. 2. The Summons is brought under the provisions of Section 71 of the Law of Succession Act (Cap 160 Laws of Kenya) and Rule 44 of the Probate and Administration Rules. 3. It seeks confirmation of the Grant herein issued on 6th June 2024 to JOYCE KWAMBOKA MARAGIA. Accompanying the Application and annexed to the said Supporting Affidavit and on the Supplementary Affidavit, are the following supportive documents: 4. A copy of the Grant; 5. The consents by the beneficiaries; and 6. The Distribution Schedule. 7. Upon perusing the Summons, the Supporting Affidavit, the Supplementary Affidavit, and all the said documents, I am satisfied that the said Grant should be confirmed. I hereby confirm it accordingly. A Certificate of Confirmation be issued. 8. I further direct the Administrator the said JOYCE KWAMBOKA MARAGIA to complete the Administration of the Estate, and transmit the shares and titles to the beneficiaries as per that distribution schedule.
