**REPUBLIC OF KENYA** **IN THE HIGH COURT OF KENYA AT KISII** **SUCCESSION CAUSE NO. E015 OF 2024** **IN THE MATTER OF THE ESTATE OF THE LATE ONGWENYI ONDIEKI (DECEASED)** **RULING** 1. This matter has come up for hearing of the Summons for Confirmation of Grant. The Grant is the one that was issued on 27th February 2025. The Summons which is dated 25th September 2025 is supported by the Supporting Affidavit of JIMMY NURU ONDIEKI ANGWENYI, sworn on even date. There is also his Supplementary Affidavit sworn on 22nd May 2026. By this consent, the beneficiaries have consented to their respective shares as listed in the schedule. 2. The Application is accompanied with a Distribution Schedule marked Annexture ‘A’ on the Supplementary Affidavit. The beneficiaries have also signed a consent to the Distribution Schedule. The consent, and which has been filed in this matter, is dated 21st July 2026, and is signed by all the five beneficiaries listed in the Distribution Schedule. ***Determination*** 1. Upon perusing the Summons together with its two affidavits and the annextures, as well as the Distribution Schedule and the consent filed by the beneficiaries, I hereby confirm the said Grant. 2. I direct that a Certificate of Confirmation of the said Grant, be issued. I further direct the Administrator to complete administration and the transmission of the beneficiaries’ respective shares; and the issuance of titles.
