In the application the 1st Petitioner/Applicant prays that:I.The County Surveyor, Kisii County, be directed to visit land parcel No. Nyaribari Chache/B/B/Boburia/5951 measuring approximately 0.38 Hectares and carry out division and demarcation of the land in accordance with the court’s ruling and orders that the estate be shared equally among the three beneficiaries.II.That the County surveyor to prepare and file in court a report showing the subdivision and demarcation undertaken for purposes of confirmation and implementation of the grant.III.That the Officer Commanding (OCS), Kiogoro Police Station do provide adequate security during the survey, subdivision and demarcation exercise to ensure compliance and maintenance of peace.IV.That the sub-division and demarcation exercise proceeds not withstanding the co-operation or absence of the 2nd petitioner, Vincent Bosire Nyagoko.V.That pending the tracing and identification of the whereabouts of Dennis Ocharo Nyagoko, his share of the estate be registered jointly in the name of the petitioners, Ann Consolata Otieno and Vincent Bosire Nyagoko as trustees to hold the same in trust pending his appearance and claim.VI.That the costs of the application be in the cause. 2.The Application is based on the grounds on the face of it and supported by the annexed affidavit Ann Consolata Otieno sworn on 3rd June, 2026. 3.The application is not opposed though the same was duly served upon the respondent.
