In this case, although both parties are Muslims, the respondent expressly declined to submit to the Kadhi Court's jurisdiction and chose to file her claim in the High Court. The Constitution grants the High Court unlimited original jurisdiction in civil matters, and the existence of the Kadhi Court does not oust this jurisdiction.
